My Lords, these regulations are the final stage in a journey which began in December , when the Government accepted an amendment in this House to include a power in the Equality Act enabling regulations to be made to outlaw discrimination in the provision of goods and services—for example, in shops and hotels—in the exercise of public functions—for example, in the delivery of health services—in education and the rental and sale of premises. We have, therefore, reached a final chapter in a process which has been inspired by a determination to create a society which is fair in all respects and to all members of society.

United Kingdom - The Equality Act (Sexual Orientation) Regulations (S.I. No. ).

These Regulations, which are made under section 81 of the Equality Act , come into force on 30 April and make it unlawful to discriminate on the grounds of sexual orientation in the provision of goods, facilities and services, education, disposal and management of premises and exercise of public functions. Sexual orientation is defined in section 35 of the Equality Act as meaning an individual's sexual orientation towards persons of the same sex as him or her, persons of the opposite sex, or both. Discrimination on grounds of sexual orientation is defined in regulation 3. Direct discrimination occurs where a person is treated less favourably than another on grounds of sexual orientation regulation 3 1. Indirect discrimination occurs where a provision, criterion or practice, which is applied generally, puts a person of a particular sexual orientation at a disadvantage and cannot be shown to be a proportionate means of achieving a legitimate aim regulation 3 3.

They legislate against discrimination on the basis of sexual orientation in the provision of goods and services including within contractual terms of employment , education, access to public facilities and public functions, and emphasise the equal rights of all citizens of the United Kingdom. Additionally, Section 15 commits religious adoption and fostering agencies to follow the Regulations and prohibits them from discriminating against applicants on the basis of sexual orientation.
